UPSON COMMISSIONERS DECISION APPEALED IN SUPERIOR COURT

A GROUP OF PROPERTY OWNERS IN THE ROLAND ROAD/OLD ALABAMA ROAD AREA HAVE FILED A CIVIL ACTION IN UPSON SUPERIOR COURT APPEALING A UNANIMOUS DECISION BY THE UPSON COUNTY BOARD OF COMMISSIONERS TO GRANT A SPECIAL EXCEPTION TO STEVE HARPER FOR A SPECIAL EVENTS VENUE ON ROLAND ROAD.

THE PETITIONERS LEAD BY ANN CAROL DANIEL ARE ASKING THE COURT TO REVERSE THE DECISION CLAIMING THE COUNTY COMMISSIONERS FAILED TO FOLLOW THE ZONING ORDIANCE IN THEIR ACTION.

VENUE OWNER STEVE HARPER IS ALSO LISTED IN THE COMPLAINT AGAINST THE COMMISSIONERS.

OTHER PETITIONERS INCLUDE CHARLES WAYNE AND PAMELA BAXTER, CHARLES AND SHIPRAH BOILS, RICHARD AND SHEILA MIKELL, NICK PETERSON AND MS. DANIEL'S SON AND DAUGHTER.

IN A MARCH LETTER SENT TO THE BOARD—MACON ATTORNEY ROBERT LOVETT CONTENDS THE SPECIAL EVENTS VENUE WILL BRING EXCESSIVE TRAFFIC, LOUD NOISE, LOWER PROPERTY VALUES, AND DISTURB THE RURAL NATURE OF THAT PART OF THE COUNTY.

ZOOM NEWS WAS TOLD NO WEDDINGS OR OTHER EVENTS HAVE BEEN HELD AT THE VENUE SINCE THE COMMISSIONERS APPROVED IT AND AT THIS POINT NONE ARE BOOKED FOR THE SUMMER.

THE CASE HAS BEEN ASSIGNED TO JUDGE FLETCHER SAMS AND COULD BE SET FOR A HEARING SOMETIME IN MAY.
