AT A PRELIMINARY HEARING WEDNESDAY, UPSON COUNTY CHIEF MAGISTRATE DANNY BENTLEY FOUND PROBABLE CAUSE AND RICHARD HARVILL OF WOODLAND ROAD WAS BOUND OVER TO THE NOVEMBER UPSON COUNTY GRAND JURY ON CHARGES OF THEFT OF SERVICES FROM THE CITY OF THOMASTON FOR $468,000. JUDGE BENTLEY ALSO REDUCED HARVILL’S BOND FROM $500,000 TO $100,000 WITH THE STIPULATION HE NOT SET UP RESIDENCY OUTSIDE THE STATE.
ONLY ONE WITNESS WAS CALLED BY ASSISTANT DISTRICT ATTORNEY HEATH ENGLISH, GBI SPECIAL AGENT SAM BAITY. DEFENSE ATTORNEYS HALE ALMOND OF MACON AND TRUITT MALLORY OF THOMASTON CALLED NO WITNESSES.
THE CRIMINAL WARRANT STATES THAT HARVILL, FORMER OWNER OF A BUSINESS CALLED AGRICYCLE HAD A VERBAL AGREEMENT WITH THE CITY OF THOMASTON TO DUMP LEACHATE FROM THE TAYLOR COUNTY LANDFILL IN THE CITY’S SEWER SYSTEM FROM JAN. 08 TO DEC. 09, BUT HE DELIVERED MORE LEACHATE TO THE CITY’S SYSTEM THAN HE REPORTED.
