UPSON TAX COMMISSIONER'S LAW SUIT ON COMMISSIONERS AGENDA

 DISCUSSION  OF  A  SETTLEMENT  AGREEMENT   OF  A  LAW  SUIT  FILED  BY  UPSON  COUNTY  TAX  COMMISSIONER  ANDY  CHASTAIN   IN   APRIL  2020       AGAINST  COMMISSION  CHAIRMAN  NORMAN  ALLEN,  THE  BOARD  OF  COMMISSIONERS,  AND  BOARD  OF  TAX  ASSESSORS  IS  ON  THE  AGENDA  FOR  TUESDAY'S  MEETING  OF  THE  COUNTY   COMMISSIONERS.  IN  THE  COMPLAINT    TAX  COMMISSIONER   CHASTAIN   CONTENDS  CHAIRMAN  ALLEN  ASKED  THE  CHIEF  APPRASER  AND  TAX  ASSESSOR  CHAIR  TO  UN-SUPPRESS    CHASTAIN'S    ON LINE   PERSONAL  PUBLIC  INFORMATION  AFTER  HE  REQUESTED  IT  BE  SUPPRESSED  FOLLOWING    A  THREAT  FROM  A   TAXPAYER.  THE  LAW  SUIT  CLAIMS  CHAIRMAN  ALLEN  TOOK  THE  ACTION  BECAUSE  CHASTAIN  SUPPORTED   HIS  OPPONENT  IN  THE  ELECTION  FOR  CHAIRMAN.  

THE   COMPLAINT   FURTHER  ALLEGES  CHAIRMAN  ALLEN  TOLD  THIRD PARTIES,  TAX  COMMISSIONER  CHASTAIN  WAS  NOT  FIT  FOR  HIS JOB. 

THE COUNTY'S LAW FERM, THE ENGLISH GROUP DID NOT REPRESENT THE DEFENDANTS DUE TO CONFLICT, SO ATTORNEY THOMAS MITCHELL OF BUFORD, GA. WAS RETAINED BY THE COUNTY, AND HE FILED THE ANSWER TO Tax COMMISSIONER CHASTAIN'S LAW SUIT.

IN THE ANSWER, ATTORNEY MITCHELL DENIED ALL CLAIMS IN THE COMPLAINT INCLUDING THAT CHASTAIN IS ENTITLED TO RE3COVER ANY DAMAGES FOR RELIEF. THE LAS SUIT STIPULATES CHASTAIN IS SEEKING DAMAGES IN EXCESS 0F $250,000.
